Before you make an offer
The work that protects you on closing day actually begins before you write the offer. Three things to have in place:
- Mortgage pre-approval, not pre-qualification — these are different. Pre-approval involves credit check, income verification, and a rate hold. Pre-qualification is an estimate
- Closing cost reserves — beyond your down payment, expect 1.5%–4% of purchase price for legal fees, LTT, title insurance, home inspection, and adjustments
- A real estate lawyer chosen in advance — not the day you sign the offer. We can review your offer before you submit it; once signed, your options narrow significantly
The Agreement of Purchase and Sale
The OREA-standard Agreement of Purchase and Sale is six pages of dense legal text. The most important clauses for first-time buyers:
- Conditions — finance condition, inspection condition, status certificate review (for condos). Each gives you the right to walk away
- Inclusions and exclusions — what stays, what leaves. Get specific. "Appliances" without listing serial numbers is a common dispute
- Closing date — match this to your mortgage rate hold and your moving plans
- Deposit — typically 5% of purchase price, held in trust by the listing brokerage

The Land Transfer Tax rebate
Ontario's Land Transfer Tax applies to every real estate purchase and is calculated on a sliding scale. For a $600,000 home, the LTT is approximately $8,475.
If you qualify as a first-time buyer, you can claim a rebate of up to $4,000. Eligibility requires:
- You are 18 or older
- You have never owned a home anywhere in the world
- Your spouse has not owned a home during your marriage/common-law partnership
- You will occupy the home as your principal residence within 9 months
If you are buying in Toronto, there is an additional municipal LTT and a separate Toronto rebate of up to $4,475 — but Ottawa has no municipal LTT, which saves Ottawa buyers thousands. Try our Ontario LTT calculator for your specific number.
Status certificate review (condos)
If you are buying a condo, the most consequential document is the status certificate. Your lawyer will request it from the condo corporation and review it in detail.
Red flags we look for:
- Reserve fund balance below 25% of fund study recommendation
- Pending special assessments (often $10,000–$30,000 per unit)
- Active litigation involving the corporation
- Recent or pending major repairs (windows, roofs, parking garage)
- Restrictions on rentals, pets, or short-term rentals
You typically have 5 to 10 business days after receiving the status certificate to either waive the condition or walk away. Use that time.
Closing costs you should expect
For a $500,000 purchase in Ottawa with a 20% down payment ($100,000):
- Land Transfer Tax (with first-time buyer rebate): ~$2,475
- Legal fees: $1,400–$1,800
- Title insurance: $350–$550
- Disbursements (registration, software, courier, search fees): $400–$700
- Home inspection: $450–$650
- Property tax adjustment to seller: variable, typically $500–$2,500
- HST on new builds (if applicable, after rebate): variable
Total closing costs typically run between 1.5% and 4% of purchase price on resale homes, higher on new construction.
What to never sign without legal review
These three documents have permanent consequences. Never sign without a lawyer reviewing first:
- The Agreement of Purchase and Sale (especially with non-standard amendments)
- Your mortgage commitment letter (we look for prepayment penalties, portability, and assumption rights)
- The Statement of Adjustments your lawyer prepares for closing
